1. Agreement

By creating an account or using Wavys AI (the “Service”), you (“Customer”) agree to these Terms & Conditions. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

2. Service Description

Wavys AI provides an AI-enabled phone receptionist and call-handling platform. Features may include call routing, automated responses, voicemail capture, transcripts, summaries, lead capture, notifications, and related dashboards.

3. AI Limitations (No Guarantees)

  • AI-generated outputs may be inaccurate, incomplete, or inappropriate.
  • You are responsible for reviewing leads, messages, and actions taken based on the Service.
  • Wavys AI does not guarantee uninterrupted service or error-free call handling.

4. Customer Responsibilities

  • Maintain accurate business information, routing rules, and forwarding settings.
  • Ensure your use complies with all applicable laws, including call-recording and consent laws.
  • Do not use the Service for unlawful, harmful, deceptive, or abusive activities.

5. Consent, Recording & Compliance

Depending on your configuration and applicable law, calls may be recorded and/or transcribed. You are solely responsible for providing required notices and obtaining any necessary consent from callers.

6. Acceptable Use

  • No harassment, fraud, spam, or illegal activity.
  • No attempts to reverse engineer, disrupt, or overload the Service.
  • No use that violates third-party rights, including privacy or intellectual property.

7. Billing, Subscriptions & Refunds

  • Paid plans renew automatically unless canceled.
  • Fees are non-refundable except where required by law or explicitly stated in writing.
  • Failed payments may result in limited or suspended access to features.

8. Third-Party Services

Wavys AI relies on third-party services such as telecom carriers, messaging and voice providers, hosting providers, and AI services. We are not responsible for third-party outages, errors, or changes.

9. Privacy

Your use of the Service is governed by our Privacy Policy. You retain ownership of your business content and grant Wavys AI the right to process data as needed to provide and improve the Service.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVYS AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST PROFITS OR REVENUE, INCLUDING DAMAGES RELATED TO MISSED OR MISROUTED CALLS, INCORRECT AI OUTPUTS, OR BUSINESS LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. SMS & Messaging

If you provide a phone number to Wavys AI, you may receive text messages related to your account, including notifications, alerts, or service-related updates. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or contact support@wavys.ai.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
